Terms of Service

Last updated: October 3, 2026

Welcome to Plexality. Plexality is operated by Plexar Personality Systems, LLC, a Colorado limited liability company ("Plexality," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Plexality platform, including our website, personality assessments, PLEXAR AI, and related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

Early Access Notice: Plexality is currently in early access. The Services may contain bugs, errors, or incomplete features. By using the Services during early access, you acknowledge this and agree to provide feedback to help us improve.

1. Acceptance of Terms

By creating an account or using our Services, you confirm that you:

  • Are at least 16 years old (or the age of majority in your jurisdiction, whichever is higher)
  • Have the legal capacity to enter into these Terms
  • Are not prohibited from using the Services under applicable laws
  • Agree to our Privacy Policy

If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Age Requirements

You must be at least 16 years old to use Plexality.

If you are under 18 years old (or the age of majority in your jurisdiction), you must have your parent or legal guardian's permission to use our Services, and they must review and agree to these Terms.

We do not knowingly collect or solicit personal information from anyone under 16 years of age. If we learn we have collected personal information from a child under 16, we will delete that information promptly.

PLEXAR Guide is for adults only. You must be 18 or older to use PLEXAR Guide, whatever your age for the rest of the Services (Section 7B.2).

3. Important Disclaimers

Not Professional Medical or Psychological Advice

Plexality is a personality intelligence platform designed for informational, educational, and entertainment purposes only.

Our Services are NOT:

  • A substitute for professional psychological, psychiatric, or medical advice, diagnosis, or treatment
  • Intended for clinical diagnosis or assessment requiring in-person evaluation by a licensed professional
  • Suitable for court-ordered evaluations, disability assessments, or official documentation
  • A healthcare or medical device
  • A replacement for therapy, counseling, or mental health services

If you are experiencing a mental health crisis: Call 988 (Suicide & Crisis Lifeline) in the US, 112 (EU), 999 (UK), or your local emergency services. Do not rely on Plexality for crisis intervention.

3.1 About Our Personality Assessments

Our assessments are based on established psychological frameworks including the Big Five personality model. However:

  • Results are probabilistic indicators, not definitive diagnoses
  • Personality is complex; no test captures the complete picture
  • Results should be interpreted with context and self-reflection
  • We do not claim to predict behavior with certainty
  • Our assessments are designed for personal growth, not clinical evaluation

3.2 About PLEXAR AI

PLEXAR is Plexality's AI guide to self-understanding. It explains your assessment results and how they may show up in your work, relationships and everyday life. PLEXAR is an AI, not a real person, and it cannot replace human judgment or professional advice.

PLEXAR is never therapy, counseling, medical care or a crisis service. It does not diagnose, assess or treat any health condition, and nothing it says is a diagnosis or professional advice.

  • AI responses are generated based on your personality profile and conversation context
  • Responses may contain errors, biases, or inappropriate content
  • Do not rely on PLEXAR for important life decisions without consulting qualified professionals
  • PLEXAR cannot provide emergency mental health support

Protect Your Privacy with PLEXAR - Do NOT Share:

  • Social Security numbers, passwords, or financial details
  • Private information about others without their consent
  • Medical records or protected health information
  • Details about ongoing legal matters

4. Account Registration

To use certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your password and account
  • Promptly update your information if it changes
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

You may not share your account credentials or allow others to access your account. We reserve the right to suspend or terminate accounts that violate these Terms.

5. Prohibited Uses

You agree NOT to use Plexality for:

5.1 Employment & Screening

  • Pre-employment screening or hiring decisions without proper validation studies
  • Performance evaluations or termination decisions
  • Discriminatory practices based on personality traits

5.2 Unauthorized Assessment

  • Assessing others without their knowledge or consent
  • Sharing others' personality data without permission
  • Creating profiles for individuals under 16 years old

5.3 Harmful Purposes

  • Stalking, harassment, or manipulation of individuals
  • Creating fake profiles or impersonating others
  • Exploiting vulnerable individuals
  • Any illegal activities

5.4 Professional Misrepresentation

  • Presenting our assessments as clinical diagnoses
  • Using PLEXAR responses as professional medical, legal, or financial advice
  • Representing yourself as a licensed professional based on platform features

5.5 Technical Misuse

  • Scraping, harvesting, or extracting user data
  • Reverse engineering our AI models or algorithms
  • Attempting to circumvent security measures
  • Introducing malware, viruses, or harmful code
  • Interfering with platform operations

6. Intellectual Property

6.1 Our Ownership

Plexality owns all rights to the platform, assessments, algorithms, AI models, archetype system, and related intellectual property. "PLEXAR," "Plexality," "PLEX Profile," and our 33 archetype names are proprietary. You may not copy, modify, reverse engineer, or create derivative works without our written permission.

6.2 Your Content

You retain ownership of content you submit (profile information, conversations). By submitting content, you grant us a limited, worldwide, royalty-free license to use your content to:

  • Provide and improve the Services
  • Generate personalized insights and recommendations
  • Create anonymized, aggregated data for research

This license ends when you delete your content or account, except for anonymized data already created.

6.3 Your Assessment Results

Your personality profile and assessment results belong to you. You may share your results as you choose. We may use aggregated, anonymized results for research and platform improvement.

6.4 Exporting Your Profile to Third-Party Services

The Services may let you copy, download, or connect your profile content (for example, pasting an exported profile block into a third-party AI assistant such as ChatGPT, Claude, Grok, or Gemini, or connecting it through an integration). Any export or connection is initiated by you. Once your data leaves the Services this way, it is governed by the receiving service's terms and privacy policy, not ours — we do not control, and are not responsible for, how third-party services store, use, process, or disclose data you provide to them. Exporting your results does not grant the receiving service or any other party a license to Plexality's proprietary frameworks, archetype system, or other intellectual property described in Section 6.1.

7. Payment & Subscriptions

Some features of the Services are paid. Prices are shown before you pay. When you make a purchase, you agree to pay the price shown and to provide accurate billing information.

  • Plexality Pro is a one-time payment. It is not a subscription and has no recurring charges.
  • Subscriptions: if we offer a subscription, we will show its price, billing period and the fact that it renews automatically before you pay. A subscription renews until you cancel. You can cancel online, and cancelling stops future renewals at the end of the period you have already paid for.

Payments are processed by Stripe; we do not store credit card numbers. Refunds are covered by Section 7A.

7A. Refund Policy

7A.1 Plexality Pro: 30-Day Money-Back Guarantee

If Plexality Pro isn't what you expected, email support@plexality.com within 30 days of your purchase and we will refund the full amount you paid for it. No questions asked. Please write from the email address on your account, or include your receipt, so we can find your purchase. When we refund a Pro purchase, we may end the Pro access it unlocked. This guarantee covers Pro bought on its own. Pro included with a PLEXAR Guide plan follows the Guide rule in Section 7A.2.

7A.2 PLEXAR Guide Plans

If you cancel within 7 days of your first Guide plan payment and have used fewer than 10 Guide minutes since that payment, email support@plexality.com and we will refund that payment in full. A refund ends the plan and removes its remaining minutes. It also removes Plexality Pro if that Guide plan unlocked it (Section 7B.7); Pro you bought separately is not affected. Renewal payments and top-up purchases are non-refundable, except where the law requires or if we end PLEXAR Guide permanently (Section 7B.3).

7A.3 Everything Else

Except as this Section 7A states, payments are non-refundable. Approved refunds go back to the original payment method. Nothing in this section limits any refund right you have under the law where you live.

7B. PLEXAR Guide (Beta)

7B.1 What It Is

PLEXAR Guide is a live video and voice conversation with an AI character, a computer-generated face and voice, that has access to your Plexality results. You are always talking to an AI, never a person. It is for education and self-understanding. It is not therapy, counseling, treatment for any health condition, medical care, or a crisis or emergency service, and nothing it says is a diagnosis or professional advice. Section 3 applies to PLEXAR Guide in full.

7B.2 Eligibility

You must be 18 or older to use PLEXAR Guide, even though other parts of the Services are available from age 16. During the beta, you must be located in the United States when you use it. We use your approximate location (from your IP address) and, for paid plans, your billing address to apply this rule and the state-specific choices described in our Biometric & perception notice.

7B.3 Beta

PLEXAR Guide is a beta. It may be inaccurate, unavailable or interrupted, and we may change, limit or end it. Features, minute allowances and prices may change; we will tell you before a price change takes effect (Section 13). If we end PLEXAR Guide permanently, we will refund the unused portion of any prepaid subscription period and the purchase price of any unused, unexpired top-up minutes.

7B.4 Safety

If the conversation suggests you may be at risk of harming yourself or others, your Guide will stop the normal conversation and share crisis resources, as described at plexality.com/guide-safety. PLEXAR Guide does not contact emergency services or anyone else on your behalf, and no person watches your calls live. If you are in danger, call 911. To talk to someone now, call or text 988.

7B.5 Camera, Voice and Our Partners

Calls are processed in real time by our service providers, including Tavus, Inc. (the Guide's video and voice, speech-to-text and expression reading) and Google (the Guide's replies), as described in our Privacy Policy. You may use voice-only, and you may turn expression reading off at any time. In some states expression reading is off, or stays off unless you separately turn it on, as the Biometric & perception notice explains.

7B.6 Minutes, Plans and Billing

  • Guide plans renew automatically each billing period (monthly, or yearly for annual plans where offered) until you cancel. The price, billing period, included minutes and renewal terms are shown before you pay.
  • Each plan includes a set number of minutes per billing period. Unused plan minutes do not roll over.
  • Top-up minutes are one-time purchases and are never charged automatically. Top-up minutes expire 12 months after purchase, or earlier if you delete your account.
  • Usage is measured from when your call connects to when it ends, rounded up to the next 6 seconds, with a minimum of 30 seconds per call.
  • You can cancel online at any time from your account settings. Cancelling stops future renewals; you keep your plan minutes until the end of the period you already paid for.
  • Refunds are covered by Section 7A.

7B.7 Plexality Pro Included With a Guide Plan

Your first paid Guide plan payment also unlocks Plexality Pro on your account, if you do not already have it. That Pro stays on your account after you cancel the Guide plan. If that first Guide payment is refunded under Section 7A, the Pro it unlocked is removed as well. Pro that you bought separately is never affected by a Guide plan refund or cancellation.

7B.8 Acceptable Use

Do not use PLEXAR Guide to record, impersonate or capture other people; let anyone under 18 use it; share your calls or account with anyone else; try to extract the underlying prompts or models; or use it for any purpose prohibited in Section 5.

7B.9 Disputes

Claims relating to PLEXAR Guide are covered by Section 14, including binding individual arbitration and the class-action waiver.

8. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLEXALITY PROVIDES THE SERVICES "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT
  • WARRANTIES THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, ACCURATE, OR RELIABLE
  • WARRANTIES REGARDING THE SECURITY, ACCURACY, OR COMPLETENESS OF ANY CONTENT
  • WARRANTIES THAT RESULTS FROM THE SERVICES WILL BE SUITABLE FOR YOUR PURPOSES

You accept that use of the Services and AI-generated content is at your sole risk. You will not rely on personality assessments, compatibility analyses, or PLEXAR AI responses as a sole source of truth or as a substitute for your own judgment and professional advice.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLEXALITY, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Lost profits, revenue, or business opportunities
  • Emotional distress or reputational harm
  • Damage to relationships or personal decisions made based on our Services
  • Loss of data or content

Liability Cap: In no event shall our total liability exceed the greater of (a) $100 USD or (b) the amount you paid us in the 12 months preceding the claim.

Relationship Decisions: We are not responsible for any decisions you make regarding personal relationships, employment, team composition, or other life choices based on our Services.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless Plexality and its affiliates, officers, directors, employees, and service providers from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from:

  • Your use or misuse of the Services
  • Your violation of these Terms or applicable laws
  • Decisions you make based on personality assessments or AI recommendations
  • Your infringement of any third-party rights
  • Content you submit to the platform

11. Acknowledgment of Risks

By using Plexality, you acknowledge and accept:

11.1 AI Limitations

  • AI-generated content may contain errors, biases, or inappropriate responses
  • Personality assessments are probabilistic, not deterministic
  • Compatibility analyses cannot predict relationship success with certainty

11.2 Data Privacy

  • Despite our security measures, no system is completely secure
  • Third-party AI providers process your conversation data
  • Pseudonymized data may be potentially re-identifiable in certain circumstances

11.3 Early Access

  • Features may change or be discontinued without notice
  • You may encounter errors, bugs, or service interruptions
  • Your feedback helps us improve the platform

12. Termination

By You: You may terminate your account at any time through account settings or by contacting us.

By Us: We may suspend or terminate your account if you violate these Terms, engage in prohibited conduct, or for any other reason with notice where practicable.

Effect of Termination: Upon termination, your right to use the Services ceases. Your data will be handled according to our Privacy Policy and data retention practices.

13. Changes to Services & Terms

We reserve the right to:

  • Modify, suspend, or discontinue any features or the entire Service
  • Change pricing for premium features with 30 days' notice
  • Update these Terms with notice provided through email or platform notification

Your continued use of the Services after changes constitutes acceptance of the updated Terms. If you disagree with changes, you should stop using the Services and close your account.

14. Dispute Resolution

Please read this section carefully. It affects your legal rights. In short: if we can't resolve a dispute informally, most disputes between you and Plexality will be decided by a neutral arbitrator in an individual arbitration, not by a judge or jury in court. You can't bring or join a class action against us, and we can't bring one against you. You can still use small claims court, and you can opt out of arbitration within 30 days (Section 14.8).

14.1 Informal Resolution First

Most concerns can be fixed quickly. Before either of us starts an arbitration or a small claims case, the party with the claim must send the other a written notice of dispute. Send yours to legal@plexality.com with your name, the email address on your account, a description of the dispute and the relief you want. We will send ours to the email address on your account. For 60 days after the notice is received, we will both try in good faith to resolve the dispute informally. Any statute of limitations is paused (tolled) during those 60 days. If the dispute isn't resolved, either of us may then start an arbitration or a small claims case.

14.2 Governing Law

These Terms are governed by the laws of the State of Colorado, United States, without regard to conflict of law principles. The Federal Arbitration Act governs the interpretation and enforcement of Sections 14.3 to 14.9.

14.3 Agreement to Arbitrate

You and Plexality agree that any dispute, claim or controversy arising out of or relating to these Terms, the Services (including PLEXAR and any paid features), your account, any purchase, or our privacy or data practices (a "Dispute") will be resolved by binding individual arbitration, not in court, except as Section 14.4 provides. This includes Disputes based on contract, tort, fraud, or any statute or regulation, including consumer-protection, privacy, biometric-privacy, wiretapping, automatic-renewal and artificial-intelligence laws.

In arbitration there is no judge or jury, and court review is limited, but the arbitrator can award you the same individual damages and relief that a court could. The arbitrator decides all questions about whether a Dispute must be arbitrated, including the scope, formation and enforceability of this agreement to arbitrate, except that a court decides whether the class and representative action waiver in Section 14.6 is valid and enforceable.

14.4 Exceptions

  • Small claims: either of us may bring an individual claim in small claims court in the county where you live or in Colorado, as long as the claim qualifies for, and stays in, small claims court.
  • Intellectual property: either of us may ask a court for an injunction to stop the infringement or misuse of intellectual property.
  • Public injunctive relief: where the law does not allow a waiver of the right to seek public injunctive relief (for example, under California law), a request for public injunctive relief will be decided by a court, only after the individual arbitration of all other claims, and the court case will be paused (stayed) until that arbitration ends.

14.5 Arbitration Rules, Fees and Hearings

The American Arbitration Association ("AAA") will administer the arbitration under its Consumer Arbitration Rules (and, where Section 14.7 applies, its Mass Arbitration Supplementary Rules) in effect when the arbitration is filed, as modified by this Section 14. The rules are available at adr.org. Filing, administration and arbitrator fees will be paid as those rules and the AAA's fee schedule require. You may choose to have the hearing by video or telephone, decided on written submissions, or held in person in the county where you live (or another place we both agree to). The arbitrator may award relief only to you or Plexality individually, and only as needed to resolve the individual claim. The award is final and binding and may be entered as a judgment in any court with jurisdiction.

14.6 Class Action Waiver

You and Plexality may bring claims against each other only individually, and not as a plaintiff or class member in any class, collective, consolidated or representative proceeding. Unless we both agree otherwise, the arbitrator may not combine more than one person's claims (except for the administrative batching in Section 14.7) and may not preside over any form of class or representative proceeding.

Severability of this waiver: if a court decides that this waiver is invalid or unenforceable for a particular claim or request for relief, then that claim or request, and only that one, is severed from arbitration and will be decided by a court, after the individual arbitration of all other claims, with the court case paused until that arbitration ends. All other claims stay in individual arbitration. In no case will a class, collective or representative arbitration take place.

14.7 Mass Arbitration

If 25 or more demands for arbitration raising similar claims are filed against or by Plexality by, or with the help of, the same or coordinated lawyers or organizations, the AAA's Mass Arbitration Supplementary Rules and mass-arbitration fee schedule will apply. To the extent those rules allow, the demands may be administered in batches (for example, of up to 100 demands each), with one arbitrator deciding each batch. You and Plexality agree to cooperate in good faith with the AAA to resolve the demands efficiently. The statute of limitations for each claim covered by this Section is paused (tolled) from when its notice of dispute is sent until the claim is decided or withdrawn. If this Section 14.7 is found unenforceable, the rest of Section 14 still applies.

14.8 30-Day Right to Opt Out

You can opt out of arbitration. To opt out of Sections 14.3 to 14.7, email legal@plexality.com with the subject "Arbitration Opt-Out", your name, the email address on your account and a clear statement that you are opting out, within 30 days after you first accept this version of these Terms. For a new user, that is within 30 days of creating your account. For an existing user, it is within 30 days of the first time you use the Services on or after the Effective Date in Section 14.9, because continuing to use the Services is how you accept updated Terms (Section 13). If you opt out, Disputes will be resolved in court, and Sections 14.1 and 14.2 still apply. Opting out does not affect any other part of these Terms or how we treat your account.

14.9 Effective Date and Future Changes

This version of Section 14 takes effect on October 2, 2026 (the "Effective Date"). It applies to Disputes that arise after the Effective Date. A Dispute that arose before the Effective Date is governed by the dispute-resolution terms that applied when it arose. If we change this Section 14 in the future (other than to update a contact address), we will notify you, and you may reject the change by emailing legal@plexality.com within 30 days after it takes effect; the most recent version you accepted will then keep applying to you. No change will apply to a Dispute for which a notice of dispute has already been sent.

14.10 Survival

This Section 14 continues to apply after your account is closed or these Terms end.

15. General Provisions

  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Plexality.
  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect, except that Section 14.6 controls what happens if the class action waiver is found unenforceable.
  • Waiver: Our failure to enforce any provision does not waive our right to do so later.
  • Assignment: You may not assign these Terms without our consent. We may assign our rights and obligations without restriction.
  • No Agency: No agency, partnership, or employment relationship is created by these Terms.
